The present application under Section 482 Cr.P.C. has been filed to quash the impugned order dated 11.10.2023 passed by the Chief Judicial Magistrate, Lucknow in Case Crime No. 381 of 2022, under Sections 406, 420, 506, 467, 468 IPC, Police Station Gomti Nagar, District Lucknow. Considering the facts that after submission of charge sheet, the court concerned has taken cognizance and thereafter, upon due consideration passed the impugned order dated 11.10.2023 under Section 82 of Cr.P.C., it is provided that the applicant shall move an appropriate application before the trial court including for recall of non-bailable warrant within a period of ten days from today. In case, such an application is moved in terms of this order, then, the same shall be considered and decided by the trial court expeditiously strictly in accordance with law. For a period of ten days, no coercive action shall be taken against the applicant so far as the proceedings in issue are concerned. The present application is disposed of in above terms.
