Court No. - 8 Case :- WRIT - A No. - 9392 of 2023 Petitioner :- Mayank Pandey Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Medical Education Lko. And 3 Others Counsel for Petitioner :- Abhishek Singh,Srideep Chatterjee Counsel for Respondent :- C.S.C., Shubham Tripathi Hon'ble Pankaj Bhatia,J.
¶1Heard the counsel for the petitioner, learned Standing Counsel as well as Sri Shubham Tripathi who appears for the respondents no. 2 to 4.
¶2The present petition has been filed by the petitioner alleging that the petitioner was appointed on the post of peon in the year 2016, however in the event, the petitioner was not given permission to undergo the typing test, as a result thereof, the petitioner had to accept the substantive appointment to the post of Peon. The petitioner moved a representation highlighting that the petitioner was wrongly denied the benefit of undergoing the typing test in the year 2016. He further claims that the petitioner was entitled for promotion. The said representation was dismissed on 17.05.2023 holding that the petitioner was appointed six years ago and has agitated his rights after a span of six years.
¶3Considering the fact that the petitioner himself had accepted the substantive appointment to the post of Peon, agitating against the same after six years, was not justified and to that extent the order dated 17.05.2023 does not require any interference.
¶4As regards the claim for promotion, the present petition is disposed off by observing that in the future, whenever exercise for considering the promotion is taken up by the respondents, the petitioner, if eligible, shall also be considered in accordance with law.
¶5The writ petition stands disposed off with the said observations. Order Date :- 11.12.2023 VNP/- High Court of Judicature at Allahabad, Lucknow Bench
