Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties. Petition has been filed seeking a direction to the opposite parties to relieve petitioners in pursuance of transfer order dated 16th June, 2023. It has been been submitted that despite the fact that petitioners have been transferred by means of order dated 16th June, 2023, they have not yet been relieved from their present place of posting at district Unnao and Gonda respectively which would have an adverse effect upon their service benefits. Although time had been granted to learned State Counsel on 9th November, 2023 to obtain instructions in this matter and although instructions have been provided to learned State Counsel but are silent as to whether the transfer order dated 16th June, 2023 is yet existing or not. In view of submissions advanced by learned counsel for parties and perusal of material on record, opposite party No.5 i.e. Commandant, 33, Vahini Pradeshik Armed Constabulary (P.A.C.), District Jhansi is directed to ensure relieving of petitioners within a period of 10 days from the date a certified copy of this order is produced before the concerned authority in pursuance of transfer order dated 16th June, 2023 in case the aforesaid transfer order is still existing as on date.
