¶1Heard the counsel for the petitioner as well as Sri Ashish Mishra holding brief of Sri Pankaj Gupta for the respondents.

¶2The present petition has been filed with the following prayer : "a writ, order or direction in nature of mandamus thereby directing the directing the Opp. Party No.1, 2 & 3 to get vacate the Gram Sabha land bearing Gata No. 183 measuring areas

0.0570 hectare situated at Village-Tiwaripur Khurd, Gram Panchayat-Barak Sarai, Pargana & Tehsil-Patti, District-Pratapgarh, which is recorded as Ghur Gadha in revenue record, encroached by the Private Opp. Party No.6 to 9, in the public interest."

¶3The Standing Counsel has produced the instructions to demonstrate that two cases under section 67 of the Act for removal of the encroachments has already been instituted which are pending.

¶4In view of the said instructions, which is taken on record, the present petition is disposed off with direction to decide the case Nos.T202302570407688 and T202302570407684 with all expedition preferably within a period of three months.
