¶1Heard learned counsel for the applicant as well as learned A.G.A. for the State and perused the record.

¶2The present application under Section 483 Cr.P.C. has been filed with the prayer to direct the learned court below to expedite and conclude the trial of Criminal Case No.8359 of 2022, under Section 138 of N.I. Act, Police Station Dhammaur, District Sultanpur.

¶3Learned counsel for the applicant has submitted that earlier Application U/S 482 No.807/2019 was filed for expedite disposal of the case in question, which was disposed of, on 31.1.2019 with a direction to the court below to decide the case in question expeditiously, if possible, within a period of six months from the date of production of certified copy of the order but till today, the same has not been decided as the private respondent is not cooperating, therefore, a direction may be issued to the court below for expeditious disposal of the case in question.

¶4Learned A.G.A. has no objection, in case, a direction for expeditious disposal of the case has been issued.

¶5Considering the arguments of learned counsel for the parties and going through the records, as on 31.1.2019, a direction for expeditious disposal of the case was passed but till today, the proceeding has not been concluded, therefore, the present application under Section 483 Cr.P.C. is disposed of with the observation that applicant may file a fresh application before the learned court below and court below is directed to decide the same, in accordance with the law.
