Judgment
Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 5951 of 2023 Petitioner :- Neelam Porwal Respondent :- Principal Judge Family Court Lko. And 2 Others Counsel for Petitioner :- Rakesh Kumar Agarwal,Saksham Agarwal Counsel for Respondent :- Rupendra Kumar Porwal(In Person) Hon'ble Rajnish Kumar,J. Shri Saksham Agrawal, learned counsel for the petitioner submits that Section 24 application filed by the petitioner has been disposed of and this petition has rendered infructuous. Shri Rupendra Kumar Porwal, the respondent in person, submits that he had filed Transfer application and only thereafter this petition has been filed concealing it. However as recorded in the order dated 23.11.2023 the petition was filed on
16.09.2023 and on account of some defect it was returned and thereafter it was filed after removal of defect on 21.11.2023. Therefore it is not the case that after coming to know about the transfer application this petition was filed, though the defects were removed and filed thereafter. In view of above, since application filed under Section 24 of the Hindu Marriage Act has been disposed of, in regard to which this petition has been filed, this petition has rendered infructuous. It is, accordingly, dismissed. . .. .................................... (Rajnish Kumar,J.) Order Date :- 11.12.2023 Banswar High Court of Judicature at Allahabad, Lucknow Bench
