Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties. Petitioner has challenged order dated 24th May, 2023 whereby he has been transferred from district Unnao to district Ayodhya on the post of Sub Inspector. Also under challenge is the order dated 4th December, 2023 whereby petitioner has been relieved in pursuance thereof. Learned counsel for petitioner has adverted to the government order dated 7th June, 2023 to submit that petitioner has almost one year left to superannuate on 31st December, 2024 and therefore would be covered under provisions of the aforesaid government order whereby he was required to be excluded from annual transfers. It is submitted that even otherwise persons similarly situated as petitioner have been excluded from annual transfers which was benefit required to be extended to petitioner as well. For the aforesaid grievance, the petitioner has already submitted a representation but seeks liberty to file a fresh representation. Considering innocuous prayer being made by learned counsel for the petitioner and without entering into the merits of the case petitioner is granted liberty to file a fresh representation within three days from today before opposite party No. 2 i.e. Additional Director General of Police, Lucknow. In case such a representation is filed, the same shall be decided within a period of ten days from the date a copy of this order is produced before the said authority. Till final decision on the representation, petitioner shall not be compelled to join at the transferred place. With the aforesaid directions, the writ petition stands disposed of.
