¶1Heard learned counsel for the parties.

¶2Shri Nikhil Singh, learned A.G.A. raised preliminary objection and submitted that the present application is filed by Shri Akash Bhanu Pratap Singh, S/o Bhanu Pratap Singh, R/o 19/1 Amrapali Vihar Rajni Khand, Raebareli Road, P.S. Aashiyana, District-Lucknow but the affidavit in support of the present application is filed by Ms. Arti Singh, W/o Shri Akash Bhanu Pratap Singh, R/o 19/1 Amrapali Vihar Rajni Khand, Raebareli Road, P.S. Aashiyana, District-Lucknow which is not permissible in the criminal justice system ass the applicant is not in custody.

¶3At this stage, learned counsel for the applicant requests for withdrawal of the application with liberty to file afresh.

¶4His prayer is accorded.

¶5Accordingly, the application is dismissed as withdrawn with the aforesaid liberty.
