Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties. Petition has been filed seeking a direction to the opposite parties to consider petitioner's grievance for payment of monthly salary for the period Ist October, 2021 till 15th February, 2022 including all admissible allowances along with interest. It has been submitted that earlier petitioner was posted as Dental Surgeon in the District Hospital Shahjahanpur which in 2020 was declared a State Autonomous Medical College. Since petitioner did not give her consent for absorption thereunder, she was posted in the office of Director General, Medical and Health, U.P. on 4th October, 2021 whereafter she performed her duties even during Covid period. It is submitted that subsequently she has been re-transferred to Shahjahanpur in Community Health Centre on 7th February, 2022 but salary for the aforesaid period has not been paid to her. For the aforesaid grievance, the petitioner has already submitted a representation dated 14th March, 2022 which has been duly forwarded to the State Government where it is still pending consideration. Considering aforesaid facts and circumstances and particularly the fact that the matter is still pending consideration before State Government and would require factual aspects as well, the opposite party No.1 i.e. Additional Chief Secretary/Principal Secretary, Medical & Health Services, U.P., Lucknow is directed to decide representation dated 14th March, 2022 within a period of six weeks from the date a certified copy of this order is submitted before him.
