Learned Additional Chief Standing Counsel raised a preliminary objection that against the show cause notice the petition is not maintainable. Even otherwise the claim of the petitioner for exchange under Section 101 of U.P. Revenue Code 2006 has already been rejected by means of the order dated 15.10.2023, a photocopy of which has been provided to learned counsel for the petitioner. He also informs that the order of eviction has partly been executed, but the remaining part was not executed and time was granted to the petitioner, but since the petitioner has not vacated, therefore, the notice has been issued. Learned counsel for the petitioner submits that the petitioner has no knowledge of order dated 15.10.2023. However a copy of the same has been provided to learned counsel for the petitioner. Even otherwise the show cause notice cannot be challenged except on certain grounds, which are not attracted in the present case.
