Learned Standing Counsel raised a preliminary objection that the proceedings before the lower court were in the name of Ram Subhag, but before this court the petition has been filed by adding @ Ram Subhak, which could not have been done, which is to be clarified by the petitioner and if he is not able to clarify he has to delete @ Ram Subhak. At this stage learned counsel for the petitioner submits that the writ petition may be dismissed as not pressed with liberty to file a fresh in the correct name. To which there is no objection by learned Standing Counsel. In view of above, the writ petition is dismissed as not pressed with the liberty as aforesaid. As prayed by learned counsel for the petitioner office is directed to return the certified copies filed alongwith the petition to learned counsel for the petitioner after keeping photocopies of the same on record in accordance with law.
