Judgment
Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 6209 of 2023 Petitioner :- Ashok Kumar Respondent :- Smt. Shanti Singh Chauhan And 2 Others Counsel for Petitioner :- Preeti Srivastava,Km. Gitanjali Shukla Hon'ble Rajnish Kumar,J. Ms.Preeti Srivastava, learned counsel for the petitioner submits that the respondent no.1 has filed a Regular Suit No.1421 of 2022 for permanent injunction with malafide intention, whereas the land in dispute does not belong to the respondent no.1. The petitioner has filed written statement and the case is at the evidence stage, therefore a direction may be issued for expeditious disposal of the suit within a time bound manner. The suit has been filed in the year 2022 and only the written statement has been filed and now the suit has been fixed for evidence, therefore at this stage no direction can be issued for disposal of the suit in a time bound manner in a case of 2022 when there is huge pendency of the cases. Even otherwise no direction can be issued by this court for disposal of the suit in a time bound manner and plea in this regard can be considered by the concerned court only on urgency being shown and if the urgency is greater than the older cases pending before the concerned court. In view of above, the petition is dismissed. . .. .................................... (Rajnish Kumar,J.) Order Date :- 13.12.2023 Banswar High Court of Judicature at Allahabad, Lucknow Bench
