¶1Present petition has been filed by the petitioner challenging the order dated 16.10.2023 whereby the appeal preferred by the petitioner challenging an order on delay condonation dated

24.04.2018 and the appeal stood dismissed.

¶2Considering the fact that both the authorities have remanded the matter for adjudication on merits and have only decided the delay condonation application, I do not see any reason to interfere with the said order. The petitioner would be at liberty to raise all defenses when the matter is finally disposed off in terms of the remand order.
