Judgment

Court No. - 3 Case :- WRIT - C No. - 10600 of 2023 Petitioner :- Jay Prakash Respondent :- State Of U.P. Thru. Secy. Revenue Civil Secrt. Lko. And Others Counsel for Petitioner :- Sudhir Kumar Pandey Counsel for Respondent :- C.S.C. Hon'ble Vivek Chaudhary,J. Hon'ble Manish Kumar,J. Heard learned counsel for the petitioner and the learned Standing Counsel. Petitioner has approached this Court for a mandamus commanding the opposite parties to ensure compliance of the interim order and peaceful possession of the petitioner over the land in dispute. Admittedly, the petitioner has filed a suit for injunction against the respondent nos. 6 to 10, restraining them from interfering in peaceful possession of the petitioner as an interim order of status quo was passed. However, the respondent nos. 11 to 14 have demolished the construction of the petitioner. There is no injunction order against the respondent nos.11 to 14 from the Civil Court. In the given circumstances, the remedy available to the petitioner is to file an appropriate suit against the respondent nos.11 to 14 with regard to damages/restoration of the earlier situation or any other appropriate remedy, if he so desires. With the aforesaid directions, the writ petition is consigned to record. (Manish Kumar, J.) (Vivek Chaudhary, J.)
