At the very outset, learned A.G.A. for the State has made a preliminary objection against the maintainability of this application. He submits that against the impugned order by which application under Section 156(3) Cr.P.C. has been rejected, a remedy lies before the Revisional Court. Learned counsel for the applicant submits that he wants to withdraw this application with liberty to avail appropriate remedy before the appropriate forum. Accordingly, in view of above, the instant application stands dismissed as withdrawn with liberty to avail appropriate remedy before the appropriate forum in accordance with law. Office is directed to return all the certified copies of relevant documents to learned counsel for the applicant after keeping photostat thereof on record.
