And Another Counsel for Petitioner :- Ranjana Agnihotri,Harshita Awasthi,Ratnesh Kant Agnihotri Counsel for Respondent :- C.S.C.,Ratnesh Chandra Hon'ble Vivek Chaudhary,J. Hon'ble Manish Kumar,J.

¶1Heard learned counsel for petitioners, Shri Ratnesh Chandra, learned counsel for Lucknow Development Authority and perused the record.

¶2The petitioners have approached this Court claiming that Plot No. D-1/106, Viraj Khand, Gomti Nagar, Lucknow was allotted and a sale deed was also executed in favour of the petitioners adjacent to the same is also a Plot No. D-1/105. Now the Lucknow Development Authority has carved out two more plots adjacent to the plot of petitioners as well as D-1/105 now bearing No. D-1/104-A and D-1/106-A. The same are likely to impact the area and boundaries of the plot of the petitioners.

¶3Shri Ratnesh Chandra, learned counsel for Lucknow Development Authority states that while on spots, the plots were being carved out, it was found that there is excess area available, hence two more plots adjacent to the plot of the petitioners numbered as D-1/106-A is also carved out. The same falls to the south of the plot of the petitioners. Thus, only the description of the boundaries of the petitioners is affecting and the new carved out plot does not in any manner reduces the boundaries of the plot of the petitioners or disturb its measurement. The said statement is taken on record.

¶4The petition is disposed of and the same is consigned to record. . (Manish Kumar, J.) (Vivek Chaudhary, J.) Order Date :- 13.12.2023 Virendra High Court of Judicature at Allahabad, Lucknow Bench
