¶1Heard the counsel for the petitioner, Mr. Syed Aftab Ahmad for the opposite parties nos. 2 and 3 and Sri Prashast Puri for the respondent no.4.

¶2The present petition has been filed with the following prayer : "A. A writ order or direction in the nature of mandamus commanding the opposite party no.2 to appoint the petitioner on any suitable post in U.P. P.C.F. on compassionate ground. B. A writ order or direction in the nature of mandamus commanding the opposite party no.1 and 4 to accord its approval to the proposal sent by the opposite party no.2 for compassionate appointment of the petitioner."

¶3Considering the fact that the issue with regard to appointment, as sought by the petitioner, is pending consideration before the respondent no.2, the present petition is disposed off permitting the petitioner to file a fresh application along with a copy of the order and the applications filed earlier by the petitioner seeking appointment before the respondent no.2 who shall decide the same in accordance with law within a period of six weeks.

¶4While doing so, the respondent no.2 shall give valid considerations to the law as explained by this court in the case of Service Single No.20906 of 2021 (Bhavna Kumari vs. State of U.P.) decided on 17.09.2021 as well as in Writ-A No.132 of 2022 (Ketki Dubey vs. U.P. Sahkari Gram Vikas Bank Ltd. and others) decided on 12.01.2022.

¶5The documents forwarded to the respondent no.2 shall also be taken into consideration by the respondent no.2. After the orders are passed by the opposite party no.2, the opposite party no.4 shall also take requisite steps in accordance with law.
