The present writ petition has been filed by the petitioner with the following prayer: "(i) Issue a writ order or direction in the nature of mandamus directing the District Magistrate, Sultanpur to take appropriate decision on the representation of the petitioner dated 02.06.2021 which is with regard to payment of Ex-Gratia amount in view of the Government Order dated 01.06.2021 due to death of father of the petitioner who died on 13.05.2021 due to infection of Covid-19 while on the duty period of Three Tier General Panchayat Election 2021." The contention of the learned counsel for the petitioner is that the payment with regard to gratuity on account of death relating to Covid-19 during the election duty stands decided by this Court through its judgment dated

25.07.2022 passed in Writ C No. 28249 of 2021 (Kusum Lata Yadav Vs. State of U.P. and Others) and subsequent order passed in review in the said very case. As the issue pending consideration before the respondent no. 3, the present writ petition is disposed of permitting the petitioner to file a fresh application along with the copy of this order and the application filed earlier by him, which shall be decided by the respondent no. 3 in accordance with law. While doing so, the respondent no. 3 will consider the decision passed by this Court in the case of Kusum Lata Yadav Vs. State of U.P. (Supra).
