¶1Heard Sri Paritosh Shukla, learned counsel for the applicant, Sri Puneet Kumar Yadav, learned A.G.A. for the State and perused the records.

¶2This is the second application seeking release of the applicant in on bail in Case Crime No. 0156 of 2022, under Sections 308, 504, 506 and 323 I.P.C., registered at Police Station Nawabganj, District Gonda. The first bail application No. - 1279 of 2023 was rejected by means of order dated 06.09.2023.

¶3Subsequent to rejection of the first bail application, the trial court had recorded the statement of the injured victim, who himself supports the allegations and who had been declared hostile.

¶4Having considered the aforesaid facts and circumstances of the case, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid crime.

¶5Accordingly, this bail application stands allowed.

¶6Let the applicant-Indrajeet Yadav be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of magistrate/court concerned, subject to following conditions:-

(i) the applicant shall not tamper with the prosecution evidence;

(ii) the applicant shall not pressurize the prosecution witnesses;
