Judgment

Court No. - 20 Case :- WRIT - A No. - 9349 of 2023 Petitioner :- Ram Ashish Alias Ram Ashish Maurya Respondent :- State Of U.P. Thru. Prin. Secy. Deptt. Of Horticulture And Food Processing Lko. And 4 Others Counsel for Petitioner :- Atul Kumar,Gauri Shankar Maurya Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J. Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties. Petition has been filed challenging orders dated 24th March, 2023 and consequential orders dated 3rd April 2023 and 4th April, 2023 whereby petitioner has been posted at Sultanpur in pursuance of minimum of scale being drawn by him of a class IV post. It has been submitted that earlier petitioner had filed writ petition before this Court seeking minimum of the pay scale of the post of Gardener in which appropriate directions were passed by this Court but despite the fact that petitioner is coming within zone of seniority with regard to available post at Ayodhya Division itself, he has been transferred to district Sultanpur on the pretext that there is no substantive vacancy existing in Ayodhya Division although he submits that such vacancies are still existing in Ayodhya Division where petitioner can can very well be accommodated. For the aforesaid grievance, the petitioner seeks liberty to file a fresh representation before appropriate authority. Considering innocuous prayer being made by learned counsel for the petitioner and without entering into the merits of the case petitioner is granted liberty to file a fresh representation before opposite party No. 2 i.e. Deputy Director of Horticulture, Ayodhya Division, Ayodhya. In case such a representation is filed, the same shall be decided by a reasoned and speaking order within with period of six weeks from the date a copy of this order is produced before the said authority. With the aforesaid observations, the writ petition stands disposed of. Order Date :- 14.12.2023 prabhat High Court of Judicature at Allahabad, Lucknow Bench
