¶1Petitioner is having a dispute with his brother with regard to the property in question for which a suit is also filed by the petitioner for cancellation of a gift deed. Petitioner claims to be occupier of a part of the said property but he is not being given electricity connection.

¶2In the given facts and circumstances, this Court is not in a position to give any finding with regard to the occupancy of the petitioner or rights of the petitioner over the property in dispute. Appropriate remedy available to the petitioner is to file an application in the suit itself which can be decided after hearing the contesting parties.
