¶1The instant writ petition has been filed assailing the order dated 31.08.2002, allowing the petitioner to continue in service with all consequential benefits up to the stage of 60 years in accordance

with

the

Government

Notification No.1098/Ka/2001 dated 28.11.2001 as also Fundamental Rule 56 (Annexure Nos.4 and 5).

¶2Considering the submissions of the learned counsel for the petitioner, this Court granted interim order on 07.10.2002.

¶3As the writ petition was filed in the year 2002 with prayer to allow the petitioner to continue in service till attaining the age of 60 years, in view of the interim order, the petitioner is continued in service. Therefore, nothing survives for adjudication in the petition.

¶4In view of the interim order, the petitioner is allowed to continue in service till attaining the age of 60 years, the respondent may calculate pensionary benefits.
