¶1Heard learned counsel for the petitioner, learned Standing Counsel for the State and perused the material available on record.
¶2The present petition has been filed challenging the order dated 14.09.2011 whereby, the fair price shop licence of the petitioner was cancelled as well as the appellate order dated 12.11.2023 whereby the appeal preferred by the petitioner was dismissed.
¶3The facts in brief are that the petitioner was a fair price shop holder and was served with a show cause notice alleging infraction in distribution as stated by various card holders.
¶4The petitioner filed a reply, however along with a reply he did not produce any distribution register to discredit the statement given against him by the card holders, as such on that ground, the version of the petitioner was disbelieved and an order came to be passed cancelling the fair price shop licence.
¶5The petitioner preferred an appeal which came to be dismissed.
¶6In the reply to the show cause notice, the memo of appeal or even in the present writ petition, there is no allegation or averment to the effect that the petitioner had submitted the documents to demonstrate that the supply was proper, which documents could have discredited the evidence against the petitioner.
¶7The orders impugned have been passed based upon evidence against the petitioner .
¶8No error can be seen from the two orders passed warranting interference in exercise of supervisory jurisdiction can be said to be made out, as such, the writ petition stands dismissed. Order Date :- 14.12.2023 Raj High Court of Judicature at Allahabad, Lucknow Bench
