In compliance of the order passed by this Court, the detenue Saptami has been produced by S.I. Ramesh Chandra Gupta as well as lady Constable Sapna Devi. Upon a query being made to the detenue, she has stated that she on her own accord and free will is residing with respondent no. 3 who is her father. She has not been illegally detained. On due consideration to the aforesaid categorical statement of the detenue, the writ of habeas corpus fails and is accordingly dismissed with a cost of Rs. 10,000/- which shall be paid by the deponent to the detenue within one month from today, failing which, the District Magistrate Balrampur is directed to recover the same as an arrears of land revenue within a further period of three months from the deponent and shall be paid to the detenue Smt. Saptami and the report to that effect shall be submitted by the District Magistrate to the Senior Registrar of this Court. Order Date :- 14.12.2023 R.C.
