Heard learned counsel for the petitioners, learned Standing Counsel and Sri Mohan Singh, learned counsel for respondent no.5/Village Panchayat. Petitioners have approached this Court claiming that respondents are raising a pucca road on petitioners' land bearing Gata Nos.893 and 854 situated at Village Chatahuwan, Tehsil Tiloi, Pargana Mohanganj, District Amethi. Learned Standing Counsel, on instructions, states that this is an old road and no constructions are being raised on gata numbers of the petitioners. Without entering into merits of the case, petitioners are permitted to move an application under Section 24 of U.P. Revenue Code, 2006 before the respondent no.2/Sub Divisional Magistrate, Tehsil Tiloi, District Amethi, raising all their grievances, annexing therewith a copy of this writ petition along with annexures and all the documents in support of their claim within a period of two weeks from today along with a certified copy of this order. In case such an application is moved by the petitioners under Section 24 of U.P. Revenue Code, 2006 for demarcation of their land bearing Gata Nos.893 and 854 situated at Village Chatahuwan, Tehsil Tiloi, Pargana Mohanganj, District Amethi, the respondent no.2, shall consider and decide the same as per proper survey report and take the matter to its logical conclusion, in accordance with law by a reasoned and speaking order after hearing all the concerned parties, within a period of two months from the date of receipt of the said application along with a certified copy of this order.
