Shri Manzar Ali Khan, learned counsel for the petitioner submits that the petitioner has filed Regular Suit No.2237 of 2022 for declaration and permanent injunction alongwith an application for interim injunction. On application for interim injunction the notices were issued on 16.11.2022 but the same has not been disposed of till date, whereas some of the parties have put in appearance. The defendants of the suit who are respondents in the present petition are threatening and disturbing the possession of the property in question, therefore there is urgency in the matter and a direction may be issued for disposal of application for interim injunction in a time bound manner. Considering the nature of the order proposed to be passed, the requirement of issuance of notice to the respondent nos.2 to 14 is dispensed with. The respondent no.1 is the court concerned. Without entering into the merit of the case, this petition is disposed of with direction to the concerned court to consider and dispose of the application for interim injunction filed by the petitioner expeditiously and preferably within a period of three months from the date of production of certified copy of this order after affording opportunity to the parties in accordance with law and without granting unnecessary adjournment to either of the parties. ...................................................................(Rajnish Kumar, J.)
