The prayer made by the petitioner in the present writ petition is for quashing of the impugned order dated 02.12.2023 where the candidature of the petitioner for grant of fair price shop licence has been rejected on the ground that a criminal case has been lodged against the petitioner. Learned Standing Counsel has produced a Government Order dated 05.8.2019 where it has been provided in Sub Clause 8 of Clause IV that the applicant should not have any criminal case registered against him and, consequently, submits that the petitioner has not assailed the validity of the aforesaid Government Order. On being confronted with the proposition Shri Shailendra Singh Chauhan, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition and file a fresh petition whereby he may assail the provision of the Government Order dated 05.8.2019.
