Judgment
Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 6278 of 2023 Petitioner :- Ram Krishna And 2 Others Respondent :- In The Court Of Civil Judge (J.D) Balrampur And 2 Others Counsel for Petitioner :- Saima Khan,Jyoti Sharma Hon'ble Rajnish Kumar,J. Ms. Saima Khan, learned counsel for the petitioners submits that inadvertently and due to typographical error, within a stipulated period has been left to be incorporated in the last line of the first paragraph of the prayer clause. Therefore she may be permitted to incorporate the same. In view of above, learned counsel for the petitioner is permitted to incorporate the same in the last line of the first paragraph during course of the day. Heard. Learned counsel for the petitioners submits that the Regular Suit No.61/2015 filed by the respondent nos. 2 and 3 for perpetual injunction is pending since 2015 and it is not being disposed of on account of several applications moved by the plaintiffs, despite a direction issued by this Court by means of the order dated 26.07.2021 passed in Writ Petition No.3323 of 2018(Anand Devi versus Vishwanath and others), therefore a direction may be issued for disposal of suit in a time bound manner. This Court by means of the order dated 26.07.2021 passed in Misc. Single No.3323 of 2018 has already issued directions to try and dispose of the matter as expeditiously as possible, therefore another direction is not required and petition with said prayer is not maintainable. Dismissed accordingly. Order Date :- 16.12.2023 Akanksha High Court of Judicature at Allahabad, Lucknow Bench
