Heard learned counsel for petitioner as well as learned AGA for the State. Notices to respondent no. 2 to 4 are dispensed with in view of the proposed order. By this petition, the petitioner has prayed for the following relief:- to issue order or direction thereby commanding/directing the opposite party no. 3 to frame the charges under Section 228 Cr.P.C. in criminal case No. 171/2021, arising out of case crime No. 24/2020, P.S. Kotwali Nawabganj, District Gonda "State Vs. Ram Kishun" expeditiously as early as possible. Learned counsel for the petitioner submits that the aforesaid case is pending for more than two years. The accused after several dates have surrendered on 19.09.2022. Thereafter continuously, he is giving exemption applications which are being allowed by the learned court below very casually without application of mind. He further submits that till date even charges have not been framed and hence, he prays that the trial court may be directed to frame charge in the aforesaid case. Learned AGA has no objection to this innocuous prayer. On due consideration to the submission advanced as well as perusal of the order sheet, the petition is disposed of directing learned court below to frame charges in the aforesaid case within a period of one month from the date of production of certified copy of this order.
