¶1Heard learned counsel for the petitioner and Shri Ran Vijay Singh, learned Additional Chief Standing counsel appearing for respondents no. 1 to 3.

¶2No notice be issued to respondent no. 4 taking into consideration the nature of order proposed to be passed.

¶3The contention of learned cousnel for the petitioner is that when the petitioner was in service he had been placed under suspension on 31.08.2016 and the petitioner retired on attaining the age of superannuation on 31.07.2023. Subsequent thereto the respondents have not paid retiral dues of the petitioner even though no chargesheet was ever issued to the petitioner subsequent to he being placed under suspension.

13.12.2023 has been passed by the State Government whereby disciplinary proceedings against the petitioner has been dropped.

¶6Accordingly, considering that disciplinary proceedings against the petitioner already stand dropped, consequently there cannot be any occasion to not pay the retiral dues to the petitioner upon he having retired.
