¶8The learned A.G.A. has opposed the prayer for bail but he could not dispute the aforesaid aspects of the matter.

¶9Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the applicant himself claims to have duped people in the name of getting employment; he has been implicated solely on the basis of his confessional statement and the recovery of documents allegedly made by him has not been witnessed by any independent person and no person has lodged any FIR against the applicant that he has duped any person and coupled with the fact that the applicant has no previous criminal history and he is languishing in jail since 04.08.2023 and co-accused Chandra Sen has already been granted bail and without making any observation, which may affect the merits of the case, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid case.
