This petition has been filed challenging the order dated 20.11.2023 passed in Regular Suit No.1088 of 2023 : Thakur Ram Janki and others Vs. Raghvendra Gupta and others by means of which the notices were issued on application for interim injunction (6-C2), while declining the ex parte interim injunction order in favour of the plaintiffs/petitioners. Learned counsel for the petitioners after arguing at some length submits that since all the respondents impleaded in this petition, have been served as per instructions, therefore a direction may be issued for expeditious disposal of the interim injunction application (6-C2), which is fixed for 20.12.2023, because the land of the petitioner no.1 which is under tenancy of the respondents, has been acquired and there is all likelihood that the respondents may encroach upon the land of temple premises. Considering the nature of order proposed to be passed, notice to the respondents is dispensed with. Without entering into merit of the case, the petition is disposed of with direction to the concerned court to consider and dispose of the application of the petitioner (6-C2), expeditiously and preferably within a period of three months from the date of production of certified copy of this order, after affording opportunity to the parties, in accordance with law and without granting unnecessary adjournments to either of the parties. .
