¶1Heard Sri Sachin Chaturvedi, the learned counsel for the applicant as well as Sri Anurag Verma, the learned Additional Government Advocate-I appearing on behalf of the State and perused the records.

¶3The aforesaid case has been registered on the basis of an F.I.R. lodged on 28.10.2023 against five persons, including the applicant, stating that the informant had purchased a flat from Yazdan Constructions through a sale deed dated 18.05.2022. The informant has further stated that through a newspaper report dated 25.03.2022 he had come to know that the building had been raised illegally and it will be demolished by Lucknow Development Authority. It has further been stated in the F.I.R. that the flat in question had been sold previously also through a sale deed dated 10.07.2019. The F.I.R. was lodged when the informant had demanded refund of sale consideration and the same had not been paid to him.
¶4In the affidavit filed in support of the anticipatory bail-application it has been contended that the applicant is innocent and he has falsely been implicated in the present case. The applicant's involvement in ten other cases has been disclosed in para 21 of the affidavit filed in support of the bail application, in two of which the applicant has been granted bail, in two cases he has been granted anticipatory bail and in two cases the Investigating Officer has submitted final report. A co-accused person Sayem Yazdani has already been granted anticipatory bail by this court by means of an order dated 05.12.2023, passed in Criminal Misc.
