Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties. Petition has been filed challenging order dated 26th May, 2023 whereby petitioner has been transferred from district Mainpuri to district Kanpur on the post of Head Constable. It is submitted that petitioner's son is suffering from epilepsy and other ailments due to which he is undergoing treatment in district Agra and is under constant supervision of the doctor concerned whereas the impugned transfer would seriously effect treatment being received by petitioner's son. For the aforesaid grievance, petitioner has already submitted a representation but seeks liberty to file a fresh representation before the authority concerned which he submits may be directed to be considered and decided. Considering innocuous prayer being made by learned counsel for the petitioner and without entering into the merits of the case petitioner is granted liberty to file a fresh representation before opposite party No. 3 i.e. Additional Director General of Police (Establishment), Polcie Head Quarter, Lucknow, U.P. In case such a representation is filed, the same shall be decided by a reasoned and speaking order within with period of six weeks from the date a copy of this order is produced before the said authority.
