Counsel for Applicant :- Arvind Kumar,Aditya Kumar Shukla Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. Learned counsel for the applicant submits that the victim is 21 years old and a consenting party. She was in relationship with the applicant for the past one year. Although the allegation of rape has been levelled and further allegation of twice aborting the victim has been levelled against the applicant, however, no material has been collected by the investigating officer to substantiate the allegation of abortion. Likewise, the allegation of video and extending threats to viral the video has also been levelled by the victim, however, again no video has been collected by the investigating officer which shows that the entire prosecution story is false. Medical does not corrborate the prosecution version. The applicant is languishing in jail since

13.10.2023 without having any criminal antecedent. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant. On due consideration to the fact that the applicant has no criminal antecedent; statement of the prosecutrix under Section 161 and 164 Cr.P.C. and without expressing any opinion on the merits of the case, I find it to be a fit case for enlarging the applicant on bail. Accordingly, the bail application is allowed. Let the applicant, Shyam Babu, involved in Case Crime/FIR No. 451/2023, under Sections 376/313/506 IPC, Police Station -Safdarganj, District -Barabanki, be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions which are being imposed in the interest of justice:-

In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law.
