Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 6313 of 2023 Petitioner :- Ramdev @ Ram Dev Vishvkrma Respondent :- Civil Judge (Junior Division), Sadar Faizabad And 8 Others Counsel for Petitioner :- Vijayendra Prakash Tripathi,Sanjeev Kumar Mishra,Swatantra Kumar Tripathi Hon'ble Rajnish Kumar,J. Heard Sri Ravindra Kumar Mishra,Advocate holding brief of Sri Vijayendra Prakash Tripathi, learned counsel for the petitioner. This petition has been filed for direction for disposal of Regular Suit No.522/2019(Ramdev and another versus Ram Anuj and Others) expeditiously as early as possible. Learned counsel for the petitioner submits that the petitioner alongwith the respondent no.2 has filed Regular Suit No.522/2019 against respondent nos. 3 to 9 for permanent injunction. The petitioner is aged about 88 years and the suit is at the stage of prosecution evidence but it is being adjourned repeatedly only for objection and disposal of the applications and the suit is not proceeding. Therefore he prays that a direction may be issued for disposal of the suit in a time bound manner being a case of old age person. Considering the nature of order proposed to be passed, requirement of issuance of notice to the respondent nos. 2 to 9 is dispensed with. The respondent no.1 is the court concerned. Without entering into the merits of the case, the petition is disposed of with liberty to the petitioner to move appropriate application before the concerned court for expeditious disposal of the suit showing the ground of urgency. In case any such application is moved within a period of one week from today, the same shall be considered by the concerned court and appropriate order shall be passed thereon within a further period of two weeks and endeavour to decide the suit expeditiously in a time bound manner, if there is no impediment.
