On an objection raised by learned Standing Counsel that this petition under Article 227 of the Constitution of India is not maintainable because this petition has been filed for direction for disposal of statutory appeal pending before the Prescribed Authority/District Magistrate, Lakhimpur Kheri under Section 15(2) of Uttar Pradesh Regulation of Building Operations Act 1958, which has been filed against the order dated 26.10.2019, by means of which the compounding has been made, Sri Vishnu Pratap Singh, learned counsel for the petitioner submits that the petition may be dismissed as not pressed with liberty to file fresh under the correct provision.
