At the very outset, Sri Subhash Bisaria, learned counsel for the applicant says that on account of some formal defects crept in this application, he does not want to press this application and it may be dismissed as withdrawn with liberty to the applicant to file a fresh application on the same cause of action with proper pleadings and evidence. The aforesaid has not been opposed. In view of the above, the instant application is dismissed as withdrawn with liberty, as prayed for.
