In view of order being passed, notices to opposite parties stands dispensed with. Petition has been filed seeking a direction to the Court concerned for early disposal of regular Suit No. 154 of 2018 instituted by petitioner for cancellation of sale deed. It has been submitted that there are five defendants in the aforesaid suit and vide order dated 15.11.2022, notice has been deemed sufficient upon all the defendants whereafter vide order dated 08.02.2023, the case has been listed for ex parte evidence at the instance of petitioner/plaintiff. Learned counsel states that no recall has been filed till date against order dated 08.02.2023. Considering aforesaid submissions by learned counsel for petitioner, the opposite party no. 1 i.e. Civil Judge (Junior Division, Court No. 30, District Pratapgarh is directed to decide the regular suit No. 154 o 2018 (Lala Ram @ Lalla versus Malti Devi and others) expeditiously, preferably within a period of six months from the date a certified copy of this order is brought on record of proceedings in case no recall has been sought with regard to order dated 08.02.2023 and in case there is no other legal impediment. The aforesaid time frame shall be subject to co-operation by the plaintiffs in early disposal. With the aforesaid directions, petition stands disposed of.
