The instant petition has been preferred seeking the following reliefs:-

(i) Issue a writ, order or direction in the nature of certiorari to qussh the impugned oral termination from service of petitioner.

(ii) Issue a writ, order or direction in the nature of mandamus commanding the opposite parties to allow the petitioner to work and pay the salary as admissible to the petitioner. The contention of the counsel for the petitioner is that the petitioner has been working since 01.11.1982 on daily wages and it is now urged that the respondents have terminated the services of the petitioner by some oral order. In the aforesaid circumstances, the petitioner has invoked the writ jurisdiction of this Court seeking the relief as noticed hereinabove. Shri Rishabh Tripathi, learned counsel appearing for the respondents submits that the instant petition is not maintainable; inasmuch as he has received instructions from the respondent no.4 indicating that the services of the petitioner have not been terminated rather the petitioner is working even as of till date in Faizabad Division. In view of the aforesaid statement, learned counsel for the petitioner submits that he may be permitted to withdraw the petition in light of the statement given by Shri Rishbh Tripathi.
