¶1Heard learned counsel for petitioner and learned State Counsel for opposite parties.

¶2Petition has been filed seeking the following main relief:-

(i) Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the Opposite Party No. 2 to grant and make payment regarding first due Assured Career Progression (A.C.P.) Grade Pay 4200 benefit, due on dated 28.12.2019 with arrear and all consequential benefits and with interest of 18 percent in time bound manner.

ii) Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the Opposite Party No 3 to grant and pay pension and pensionary benefits which is due to petitioner for payment on date of retirement is NPS Rs-10,25,570 GIS(Group Insurance Scheme) 21874 INR, Gratuity 500526 INR and monthly Pension as per Govt Rules dated 2.11.1995 Notified under clause (3) of Article 348 of the Constitution of India.

¶3For the said grievance, petitioner has already submitted a representation but seeks liberty to file a fresh representation before the authority concerned. At present, learned counsel for petitioner restricts prayer with regard to final decision on the same.

¶4Considering the innocuous prayer, without entering into merits, liberty is granted to petitioner to file a fresh representation before opposite party no.2 i.e. Director, Bal Vikas Sewa and Pushtahar, Lucknow who shall consider and decide the same within a period of eight weeks from the date a certified copy of this order is produced before the said authority along with fresh representation.
