¶1Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties.

¶2Petition has been filed seeking following relief:- "(i) To issue a writ, direction or order in the nature of Mandamus commanding and the respondents may be directed to immediately release the 90 % of the G.P.F amount to the petitioner, along with his gratuity and pension, as soon as possible.

(ii) To issue any other writ, order or direction which this Hon'ble court may deem fit and proper under the facts and circumstances of the case.

(iii) To allow the writ petition with costs."

¶3It has been submitted that despite the fact that petitioner has superannuated on 30.09.2023 and has also been issued no due certificate from all the concerned departments but the aforesaid payment has not been paid.

¶4For the aforesaid grievance, petitioner has already submitted a representation but seeks liberty to file a fresh representation before competent authority. At present learned counsel for petitioner restricts his prayer for a final decision with regard to same.

¶5Considering innocuous prayer being made by learned counsel for petitioner and without entering into the merits of the case petitioner is granted liberty to file a fresh representation before opposite party No.2 i.e. Engineer in Chief, Public Words Department U.P. M.G. Marg, Lucknow (concerned authority). In case such a representation is filed, the same shall be considered and decided within a period of six weeks from the date a certified copy of this order is produced before the said authority.
