Judgment

Court No. - 7 Case :- WRIT - A No. - 9791 of 2023 Petitioner :- Sahab Lal Yadav Respondent :- U.P. Forest Corporation Thru. Managing Director, Lucknow And 3 Others Counsel for Petitioner :- Dilip Kumar Pandey,Krishna Pratap Singh,Manoj Kumar Counsel for Respondent :- Rishabh Tripathi Hon'ble Abdul Moin,J. Heard learned counsel for the petitioner and Shri Rishabh Tripathi, learned counsel for all the respondents. With the consent of learned counsel appearing for the contesting parties, the writ petition is being finally disposed of. The contention of learned counsel for the petitioner is that at the time of his initial appointment as a Daily Wager in the year 1982, as per the High School certificate, his date of birth was correctly recorded as 10.12.1965. It is contended that recently with the issuance of seniority list, the date of birth of the petitioner has been indicated as

10.12.1963. The contention is that there cannot be any occasion for the respondents to have changed the date of birth which already stands recorded in the service record from 10.12.1965 to

10.12.1963 and prays that the correct date of birth i.e.

10.12.1965 be continued to be recorded in the service records. After arguing the matter at some length, learned counsel for the petitioner submits that with regard to the reliefs sought in the writ petition, the petitioner may be permitted to submit a fresh representation before the respondent no.2 i.e. Regional Manager, U.P. Forest Corporation, Eastern Circle, Gorakhpur which may be directed to be decided within a time frame fixed by this Court to which learned Counsel for the respondents has no objection. In view of the above, it is provided that in case the petitioner submits a representation within two weeks from today before respondent no.2 then respondent no.2 shall endeavour to decide the same by means of a reasoned and speaking order in accordance with law and the relevant rules within a further period of four weeks from the date of submission of the representation along with certified copy of this order. With the aforesaid direction, writ petition is disposed of. It is made clear that this Court has not gone into the merits of the claim set forth by the petitioner. Order Date :- 20.12.2023 S.
