Heard Sri Ramendra Kumar, learned counsel for the applicant as well as the learned A.G.A. and perused the record. This application has been filed by the applicant seeking transfer the case bearing Old Sessions Trial No. 880 of 2018, State v. Sukaru alias Sandeep Kumar Dubey & ors., arising out of Chargesheet No. 9A/2018, Case Crime No. 293 of 2017, under Section 302, I.P.C. and Section 3(2)(v), S.C./S.T. (P.A.) Act, P.S. Machhrehta, District Sitapur, peding before the court of learned Special Judge [S.C./S.T. (P.A.) Act], Sitapur, to any other subordinate District Court from there. Learned counsel for the applicant submits that due to some misunderstanding learned Presiding Judge of the concerned court is enimical to the applicant and the applicant has no hope of finding justice from him, thus, in such circumstances, this court be transferred from his court to some other court in the State of U.P. Learned A.G.A. opposed the prayer for transfer made by the learned counsel for the applicant. He further stated that on his ground cases cannot be transferred. No good ground has been made for transfer of the case from one District to another District. The application is accordingly dismissed. (Shamim Ahmed, J.)
