¶1Heard Sri Anuj Kumar Singh, the learned counsel for the applicant as well as Sri Manish Kumar Pandey, the learned A.G.A.-I for the State and perused the record.

¶2The instant application has been filed seeking release of the applicant on bail in Case Crime No. 263 of 2023, under Section 379, 411 I.P.C. and Section 3/5/8 of Uttar Pradesh Prevention of Cow Slaughter Act, 1955, registered at Police Station Sirsiya, District Shrawasti.

¶3The aforesaid case has been registered on the basis of F.I.R. lodged on 29.09.2023 alleging theft and slaughter of the informant's bull committed by unnamed persons.

¶4The police claimed to have arrested six persons, including the applicant on the basis of information received form a mukhbir and some remains of the bull are said to have been recovered from there. A pistol is said to have been recovered from the applicant.

¶5In the affidavit filed in support of the bail application, it has been stated that the applicant is innocent, he has been falsely implicated in the present case and he has no criminal history.

¶7The learned A.G.A. has opposed the prayer of the bail, but he could not dispute the aforesaid aspects of the matter.

¶8Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the F.I.R has been lodged against the unknown person; the applicant has been implicated on the basis of information received from a mukhbir and the alleged recovery has not been witnessed by any independent person and that a co-accused person has already been granted bail, coupled with the fact that the applicant has no criminal history and he is languishing in jail since
