Heard learned counsel for the petitioner and learned counsel for the respondent/R.B.I. Learned counsel for the respondent/Reserved Bank of India has raised an objection that the petitioner has an alternative remedy under Section 22(5) of the Banking Regulation Act, 1949 read with Section 56 of the Cooperative Societies by filing an appeal before the Central Government. In view of the availability of alternative remedy, this Court is not inclined to interfere with the present writ petition under Article 226 of the Constitution of India. It is, however, provided that in case the petitioner files the stay application along with the appeal, the same shall be considered and decided by the appellate authority in accordance with law without any delay.
