Judgment
Court No. - 20 Case :- WRIT - A No. - 9856 of 2023 Petitioner :- Balwan Singh Yadav Respondent :- State Of U.P Thru. Addl. Chief Secy. Deptt. Revenue Lko. And 6 Others Counsel for Petitioner :- Shrawan Kumar Verma Counsel for Respondent :- C.S.C. Hon'ble Manish Mathur,J.
¶1Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties no.1 to 5 and 7.
¶2In view of order being proposed to be passed, notices to opposite party no.6 stand dispensed with.
¶3Petition has been filed challenging order dated 25.07.2023 and letters dated 28.06.2023 and 14.07.2023 to the effect that petitioner's secretariat entry pass issued to him earlier in lieu of his duties as a Chainman/ Dark Running has been withdrawn.
¶4It has been submitted that the aforesaid orders and letters have been issued on account of complaints levelled against petitioner which were inquired into and therefore withdrawal of aforesaid secretariat pass indicates cast stigma upon petitioner.
¶5Mr. Sandeep Chandra, learned State counsel however has refuted submissions advanced by learned counsel for petitioner with the submission that the petitioner does not have any vested right for issuance or continuance of secretariat pass. It is further submitted that even as per averments made in petition, there is no change in petitioner's status as an employee or any emoluments.
¶6Considering submissions advanced by learned counsel for parties and perusal of material available on record, it is quite evident that by means of impugned orders and letters, only secretariat entry pass issued earlier to petitioner has been withdrawn.
¶7Learned counsel for petitioner has been unable to satisfy this Court as to any vested right of petitioner for continuance or issuance of such secretariat entry pass particularly since his status as an employee and his emolument thereof remain unchallenged.
¶8In view of aforesaid, petition being devoid of merits is dismissed at the admission stage itself. Order Date :- 21.12.2023 Subodh/- High Court of Judicature at Allahabad, Lucknow Bench
