Heard learned counsel for petitioner and learned State Counsel for opposite parties. Petition has been filed seeking a direction to opposite parties to consider his posting at Rajkiya Usar Sudhar Prakshetra Khand Majhgaon, Rahimabad, Lucknow. It has been submitted that earlier petitioner was transferred to Rahimabad, Lucknow vide order dated 28.06.2023 where he submitted his joining on 01.07.2023 but subsequently due to transfer of one Mr. Virendra Ram, petitioner was posted in his place. The said person thereafter filed Writ-A No. 5711 of 2023 in which this Court while passing interim directions provided certain protection to him and in pursuance whereof, the opposite parties have passed order dated 10.11.2023 re-establishing the said Mr. Virendra Ram in his earlier place of posting due to which petitioner is now left without a posting. It has been submitted that since petitioner had been posted in place of Mr. Virendra Ram who has thereafter been reinstated in his earlier place of posting, petitioner is also entitled to be re-posted in his earlier place of posting. Upon consideration of submissions advanced and perusal of material on record, submission advanced by learned counsel for petitioner who appears to have force and for the said purpose, he is granted liberty to file a representation before opposite party no. 3 i.e. The Additional Director, (Administration) Agriculture Bhawan, U.P. Lucknow who shall consider and decide the same within a period of two weeks from the date of submissions of certified copy of this order in the light of the discussion made hereinabove.
