¶1Heard learned counsel for petitioner and learned State Counsel for opposite parties.

¶2Petition has been filed for the following relief:- "1-Issue a writ, order or direction in the nature of mandamus commanding the opposite party no. 3/ District Panchayat Raj Officer (DPRO), District-Raibareilly to remove the anomaly and fix the correct salary of the petitioner and ensure the payment of correct salary to the petitioner as received by his colleague employees and pay entire arrears (difference of salary) to the petitioner along with interest @ 8% up to the actual date of payment to the petitioner. 2-Issue any other order or direction, as this Hon'ble Court may deem fit and proper under the facts and circumstances of the case. 3-To allow the writ petition with cost."

¶3For the said grievance, petitioner has already submitted a representation but seeks liberty to file a fresh representation before the authority concerned. At present, learned counsel for petitioner restricts prayer with regard to final decision on the same.

¶4In view of fact that consideration of petitioner's grievance would entail factual aspects and in view of innocuous prayer, without entering into merits, liberty is granted to petitioner to file a fresh representation before opposite party no.3 i.e. District Panchayat Raj Officer, District Raebareli who shall consider and decide the same within a period of eight weeks from the date a certified copy of this order is produced before the said authority along with fresh representation.
