(1) Heard the learned counsel for the petitioner and the learned A.G.A. who appears for the Opposite party nos.1, 2 & 3.
(2) This petition has been filed by the petitioner for the following main prayer:- "1) Issue a writ, order or direction in the nature of Certiorari quashing the impugned First Information Report dated 22.07.2023 registered at Police Station Jethwara, District Pratapgarh, in F.I.R./ Case Crime No.0144/2023, under Sections 419, 420, 467, 468, 471 & 409 I.P.C., so far as the petitioner is concerned as contained in Annexure No.1 to the writ petition."
(3) It has been submitted by the learned counsel for the petitioner that the petitioner is completely innocent and he has been falsely implicated in the impugned F.I.R. He has pointed out Annexure No.9 to the writ petition which is an order of appointment of the petitioner dated 31.07.2014 under Dying in Harness as Village Development Officer (V.D.O.). He says that he was appointed on 31.07.2014 and sent for training thereafter for 15 days and joined as V.D.O./Secretary Gram Panchayat, on 30.07.2014. It has been submitted that the account of Smt. Meena Devi wife of Jagannath, was opened on 21.06.2014 in Bank of Baroda, Branch Katra Gulab Singh, District Pratapgarh, bearing Account No.35610100015312 and the joining of the petitioner was of 31.07.2014, hence, there is no chance of committing fraud by the petitioner.
(4) We have gone through the F.I.R. which has been lodged after Preliminary Fact Finding Enquiry has been made and from the same it appears that the account of Smt. Meena Devi wife of Jagannath, was opened on
26.12.2014 and not on 21.06.2014 as alleged by the petitioner.
(5) This Court having gone through the F.I.R. finds no good ground to show interference in the matter.
